If any right in or under an application for registration of a design (“design application”) or a registered design is acquired by virtue of any of the following transactions, instruments and events, please file Form D5 with prescribed fee to update the Designs Registry's records.

1. an assignment;
2. a mortgage or the granting of security;
3. the grant or assignment of a licence or sub-licence or mortgage of a licence or sub-licence;
4. the vesting by an assent of personal representatives of a design application/registered design or any such right;
5. any order or directions of a court or other competent authority transferring a design application/ registered design or any such right.

Documentary evidence is NOT required to be filed if the Form D5 is signed by or on behalf of the assignor, mortgagor, grantor of the licence or security. Otherwise, the application shall be accompanied by such evidence as suffices to establish the transaction, instrument or event.
