When should you file?

You need to file a request for registration and grant in the Hong Kong Special Administrative Region (the Hong Kong SAR) (Form P5) within six months after publication of the request to record in the Hong Kong SAR, or the grant of the designated patent by the designated patent office, whichever is the later.

You need to provide documents and information for your patent application.

Filing fee and advertisement fee

You need to pay a filing fee and an advertisement fee within one month of the earliest filing of any part of your request for registration and grant.

We will allot a filing date to your request for registration and grant when your form P5 contains:

1. information identifying the applicant, such as the name and address of the applicant;
2. a reference to the corresponding designated patent (i.e. the publication number of the designated patent and the date of its publication); and
3. the publication number of the corresponding request to record.

If we have given your request for registration and grant a filing date, we will examine your request on formal requirements and give you notice to correct any deficiencies within two months.
